Agreement to Terms

Welcome to BaKala’O Kitchenette (“BaKala’O”, “we”, “us”, or “our”). By accessing or using our website (bakalaokitchenette.com), ordering platforms, catering inquiry services, or physical restaurant premises at 1002 Tremont St, Boston, MA, you agree to comply with and be bound by these Terms of Service.

If you do not agree to these terms, you must discontinue your use of our site and digital ordering services immediately.

Orders, Pricing, and Payments

All orders placed through our digital channels are subject to kitchen availability and acceptance. Prices listed on our menu are in United States Dollars (USD) and do not include applicable Massachusetts state and local meals taxes (which are calculated at checkout).

  • Price Adjustments: We reserve the right to revise menu prices, daily specials, and ingredient substitutions without prior notice based on seasonal market availability.
  • Secure Payment: Online payments are processed through PCI-DSS certified payment processors. We do not store full credit card numbers or sensitive CVV codes on our servers.
  • Age Requirement: You must be at least 18 years old (or the legal age of majority in your jurisdiction) or accompanied by a parent or legal guardian to submit online orders.

Direct Pickup & Third-Party Delivery

We offer multiple ways to enjoy BaKala’O meals:

Direct Kitchen Pickup

Orders placed for direct pickup must be collected at 1002 Tremont St, Boston, MA 02120 during our regular hours (Monday–Saturday, 10:00 AM – 9:00 PM; closed Sunday). Freshly prepared hot food is held safely under warming conditions for up to 45 minutes past the scheduled pickup window.

Third-Party Delivery Platforms

When ordering through DoorDash, Uber Eats, or Grubhub, delivery dispatch, courier transit times, driver tips, and platform fees are governed by the respective provider’s terms and customer support.

Food Safety & Allergen Advisory

warning Consumer Advisory for Common Food Allergens:

Our kitchen prepares dishes containing seafood/fish (codfish/bacalao), dairy (cheese, butter), gluten/wheat (empanada dough, brioche buns), eggs, and legumes (beans, gandules). While we follow strict sanitization protocols, cross-contact with allergens may occur in a commercial kitchen environment.

Please notify our staff before ordering if you or anyone in your party has a food allergy.

Modifications, Cancellations, and Refunds

Because our dishes are prepared fresh to order, cancellations must be requested within 5 minutes of placing the order by calling the kitchen directly at (617) 238-5653.

If there is an error with your order (such as a missing item or incorrect preparation), please notify us immediately upon receiving your meal. We will gladly remake the item, issue a store credit, or process a refund for the affected dish.

Intellectual Property Rights

All brand elements, including the BaKala’O Kitchenette logo, script typography, photographic assets, custom menu item naming conventions, website design system, and written content, are the exclusive intellectual property of BaKala’O Kitchenette LLC. You may not reproduce, scrape, distribute, or modify any materials without prior written consent.

Limitation of Liability & Governing Law

To the fullest extent permitted by applicable law, BaKala’O Kitchenette LLC and its members, employees, and agents shall not be liable for any indirect, punitive, or consequential damages arising from website downtime, delays caused by third-party delivery dispatchers, or technical errors.

These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to any conflict of law principles.
